1) Acceptance of Terms
By accessing or using the Site, you agree to these Terms of Use (the “Terms”). If you do not agree, do not use the Site.
We may update these Terms from time to time. Changes take effect when posted on the Site. Your continued use of the Site after changes are posted means you accept the updated Terms.
2) Availability and Intended Use
The Site is made available to support Atlas products and services. Access to the Site may not be legal or appropriate in all jurisdictions, and we do not make representations that the Site or its content is available for use everywhere.
You are responsible for ensuring that your access to and use of the Site complies with applicable laws and regulations.
3) Permitted Use
You may use the Site for lawful purposes and in accordance with these Terms. The Site is provided for informational and commercial purposes relating to Atlas products and services.
4) Account Registration and Security
If you create an account, you agree to:
- Provide accurate, current, and complete information, and keep it updated;
- Keep your username and password confidential;
- Use your account only for authorized purposes and not allow others to access it improperly;
- Notify us promptly if you suspect unauthorized access or a security incident;
- You are responsible for all activity that occurs under your account, except to the extent caused by our negligence or failure to maintain reasonable safeguards.
5) Prohibited Activities (Acceptable Use)
You agree not to, and not to attempt to:
- Access or use the Site for any unlawful purpose;
- Interfere with or disrupt the Site, servers, or networks;
- Probe, scan, test, or breach the security of the Site or any connected systems;
- Use bots, scrapers, spiders, or automated tools to access, copy, or extract data from the Site without our written permission;
- Circumvent or attempt to circumvent any access controls, rate limits, or security features;
- Reverse engineer, decompile, or attempt to discover source code or underlying components of the Site (except where prohibited by law);
- Introduce malware, viruses, or other harmful code;
- Impersonate any person or entity or misrepresent affiliation with Atlas.
6) Intellectual Property
All content on the Site, including text, graphics, logos, images, design elements, and software, is owned by Atlas or its licensors and is protected by intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from Site content without our prior written consent, except as permitted by law.
7) Third-Party Services and Links
The Site may reference or link to third-party websites or services. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party sites is at your own risk and subject to their terms.
8) Site Content; No Professional Advice
Information on the Site is provided for general informational purposes only. It is not medical, clinical, legal, or other professional advice. You should consult qualified professionals for advice specific to your situation.
9) Suspension and Termination
We may suspend, restrict, or terminate access to the Site or your account at any time, with or without notice, if we reasonably believe:
- You have violated these Terms;
- Your use poses a security risk;
- Your use may harm Atlas, our customers, or third parties; or
- We are required to do so by law.
10) Disclaimers
THE SITE AND ALL CONTENT AND SERVICES PROVIDED THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components.
11) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATLAS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATLAS’S TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO ATLAS THROUGH THE SITE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR CAD $100 IF YOU HAVE NOT MADE ANY SUCH PAYMENTS.
Some jurisdictions do not allow certain limitations of liability, so some of these limits may not apply to you.
12) Indemnification
You agree to indemnify and hold harmless Atlas and its directors, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to your use of the Site, your violation of these Terms, or your infringement of any rights of another person or entity.

Privacy Policy
This Privacy Policy explains how we collect, use, disclose, and protect personal information. We handle personal information in accordance with applicable privacy laws.
Our Privacy Commitment
Atlas knows how important it is to protect your personal information. We want your experience with our Site and services to be enjoyable, safe, and secure. This Privacy Policy describes our guiding principles and practices for collecting, using, and protecting personal information.
1) What We Collect
A) Information You Provide
Depending on how you use the Site, we may collect:
- Contact information (name, email, phone number, mailing/shipping address)
- Account credentials (username/password and account settings)
- Order and transaction details (items purchased, shipping preferences, order history)
- Communications (emails or messages you send to us)
B) Health-Related or Sensitive Information
In the course of fulfilling orthotic-related orders, we may receive or collect information that may be considered sensitive, including patient names and other health-related details required to manufacture or fulfill orders.
We treat sensitive information with heightened care, limit access to those who need it, and apply safeguards appropriate to its sensitivity.
C) Information Collected Automatically
When you use the Site, we may automatically collect:
- IP address and general location derived from IP
- Device and browser information
- Pages viewed, time spent, referring/exit pages, and interactions
- Log data for security and troubleshooting
2) 3D Scanning Solution with TrueDepth Camera Sensor
A) What information does our scanning application (or app) collect using the TrueDepth API?
During capture, the app collects the front-facing TrueDepth camera’s depth and RGB information from frames using the TrueDepth API. The app also collects TrueDepth camera metadata, which may include the TrueDepth camera’s intrinsic matrix and distortion information (such as a distortion map), where available and applicable to the device and capture mode.
B) For what purposes does the app collect this information?
The app uses this information to perform a depth-processing workflow (including depth fusion and related processing) to generate the colored 3D representation of the scanning object.
Important note about access: our version of the app does not expose saved scans or exported scan files directly to the end user within the app. Instead, scan data and scan outputs are uploaded to Atlas’s secure infrastructure and are made available only through Atlas systems to authorized users and workflows (for example, for order fulfillment and related services).
C) Will the data be shared with any third parties?
Scan data is used for generating the 3D output and supporting Atlas services. We do not sell scan data or share it with third parties for their own independent purposes.
We may use trusted service providers (for example, secure hosting, storage, and processing providers) to operate our infrastructure and deliver the service. These providers are permitted to process information only on our behalf, under appropriate contractual and security obligations.
D) Where will this information be stored?
During the capture and processing workflow, the app may store collected data (including depth information, RGB images, and camera metadata) in a temporary folder within the app’s local storage. All data in the temporary folder may be overwritten during the next scanning session and may also be removed automatically when the user uninstalls the app or logs out, depending on device behavior and OS constraints.
After capture, scan data and/or scan outputs are uploaded to Atlas’s secure infrastructure for storage and processing as part of providing the service. Where applicable and upon verified request, Atlas may delete stored scan data from its systems, subject to legal, operational, and record-keeping requirements.
3) How We Use Information
We use personal information to:
- Provide and administer accounts and Site features
- Process and fulfill orders, including confirmations and service communications
- Provide customer support and respond to inquiries
- Prevent fraud, protect Site security, and investigate suspicious activity
- Improve our Site, products, and services (analytics, troubleshooting, performance)
- Comply with legal obligations and enforce agreements
- Send marketing communications where permitted by law and subject to your preferences
4) Consent and Your Choices
We collect, use, and disclose personal information with consent, except where permitted or required by law.
A) Marketing Emails
You can opt out of marketing emails at any time using the unsubscribe link in our messages or by contacting us at legal@atlasorthoticlab.com. Transactional or service-related emails (e.g., order confirmations) may still be sent as necessary.
B) Implied Consent
In some cases, your consent is implied if we request personal information for a stated purpose (for example, to respond to a customer service request or to fulfill an order).
C) Express Consent
In other cases, we may ask for your express consent (for example, to send promotional information where required by law). You can withdraw consent as described above.
5) Payments and Payment Processing
We use third-party payment processing services, including VersaPay Systems, to process payments. Payment information is handled by our payment processors and related financial service providers in accordance with their policies and security requirements. Atlas does not store full payment card details except as necessary to administer transactions or as permitted by our processors.
6) Cookies, Analytics, and Email Tools
We use cookies and similar technologies for essential site functionality and to understand how the Site is used.
A) Cookies
Cookies are small text files that your browser places on your device when you visit a website. Cookies help enable core functionality and can help us understand how our Site is used. You can control cookies through your browser settings. If you disable cookies, some Site features may not function correctly.
B) Google Analytics
We use Google Analytics to collect information about how visitors use the Site (e.g., pages visited, time on site, device/browser data). This helps us improve Site performance and user experience.
C) Email and Marketing Platforms
We use Mailchimp and Klaviyo for email communications and marketing. Transactional email may be delivered through Mandrill (Mailchimp).
These providers may process personal information on our behalf under contractual restrictions and safeguards.
7) Registered Customers Only; Prohibited Use
The Atlas-IO Lab 3D scanner is offered to registered customers of Atlas only. Any access to or use of the scanning features outside of this customer relationship, or for any unauthorized purpose, is prohibited.
8) When We Share Personal Information
We do not sell personal information.
We may share personal information with trusted service providers who perform services on our behalf (for example, hosting, storage, analytics, customer support, fulfillment, delivery services, and payment processing). These providers are permitted to use personal information only to perform services for Atlas and must protect it under appropriate contractual and security obligations.
Service providers and related infrastructure may be located in Canada and the United States, and personal information may be processed or stored in those jurisdictions, subject to applicable laws.
We may also disclose personal information where permitted or required by law (for example, to comply with a lawful request, subpoena, warrant, court order, or other legal process, or to protect the rights, property, or safety of Atlas, our customers, or others).
9) Data Retention
We retain personal information only as long as necessary to fulfill the purposes described in this Policy, and as required by law or legitimate business needs. When information is no longer required, we securely destroy or de-identify it.
We may also de-identify and aggregate information so it can no longer reasonably be used to identify an individual, and use it for internal analytics, trend analysis, audits, service improvement, and statistical purposes.
10) Access, Correction, and Privacy Requests
Subject to legal limitations and identity verification, you may request access to your personal information, request corrections, or ask questions about our practices by contacting legal@atlasorthoticlab.com.
In some cases, we may charge a reasonable fee where permitted by law (for example, to cover administrative costs), and we will inform you in advance.
11) Contests, Promotions, and Surveys
From time to time, Atlas may run contests, promotions, or surveys. If you participate, you may be asked for contact information and optional survey information. Information from contest entries may be used to administer the promotion, contact winners, and deliver prizes where applicable. We may use de-identified or aggregated results for analysis and service improvement. All contests and promotions are subject to any additional rules made available with the specific promotion.
12) Third-Party Links and Social Features
The Site may include links to third-party sites or embedded tools (including social features). Third parties may collect information directly from you. Their privacy practices are governed by their own policies, and we are not responsible for them.
13) Complaints and Response Time
We investigate privacy-related complaints and aim to respond within thirty (30) business days after receipt of written correspondence or voicemail. If a complaint is found to be justified, we take appropriate measures to resolve the complaint, including, if necessary, amending our policies and practices.
